This website, spyhold.com, is operated by SPYHOLD LLC ("Spyhold," "we," "us," or "our").

By accessing or purchasing from this site, you agree to these Terms of Service.

1. Use of the Site

You must be at least 13 years old to use this site and agree to use it only for lawful purposes.

2. Products and Availability

All products, pricing, and descriptions may change. We may modify or discontinue items at any time. We may refuse or cancel orders including for suspected fraud, errors, or misuse.

3. Accuracy of Information

You agree to provide accurate and complete information at checkout.

Digital gift cards purchased at spyhold.com are also subject to our Gift Card Terms. Those terms govern gift card purchases, delivery, redemption, remaining balances, and any legally required cash redemption. If they conflict with these Terms of Service on those matters, the Gift Card Terms control to the extent permitted by law.

4. Intellectual Property

All content on this site including product names, images, text, graphics, and design is owned by Spyhold and may not be used without permission.

5. Intended Use and Assumption of Risk

5.1 General-Purpose Accessories. Spyhold products are general-purpose carrying accessories designed for everyday use. Spyhold does not manufacture, sell, distribute, or endorse nicotine, tobacco, or any controlled or age-restricted substance. Spyhold makes no representations regarding the safety, legality, or suitability of any third-party product stored in a Spyhold accessory.

5.2 Assumption of Risk. The purchaser assumes all risk and responsibility for the items stored in or carried using Spyhold products, including but not limited to compliance with all applicable federal, state, and local laws regarding those items. Spyhold shall not be liable for any injury, illness, property damage, or legal consequence arising from the contents placed in its products by any person.

5.3 Parental and Guardian Responsibility. Spyhold products are intended for use by adults. Spyhold assumes no responsibility for the storage, access, or use of any items placed inside its products by any third party, including minors. Parents, guardians, and other adults are solely responsible for keeping any age-restricted, hazardous, or otherwise dangerous items stored in Spyhold products out of the reach of children and unauthorized persons.

5.4 Product Misuse. Spyhold is not liable for any injury, harm, loss, or damage resulting from (a) the misuse of its products; (b) the storage of hazardous, illegal, or age-restricted items in its products; (c) any third party's access to items stored in a Spyhold product; or (d) the use of Spyhold products for any purpose other than their intended function as carrying accessories.

5.5 No Endorsement. Any reference to third-party products, including nicotine pouches, in Spyhold marketing materials, product descriptions, or imagery is for illustrative purposes only and does not constitute an endorsement, recommendation, or promotion of such products. Spyhold does not encourage or facilitate the use of any age-restricted substance.

6. Warranty Disclaimer

Products are provided "as is" except where stated. Spyhold disclaims implied warranties including merchantability, fitness for a particular purpose, and non-infringement to the fullest extent allowed by law. Products include a one-year warranty for manufacturing defects. This warranty does not cover damage caused by misuse, modification, improper storage, or the storage of items that damage or degrade the product.

Our product warranty covers eligible physical products, not the gift card itself. Buying a physical product with a gift card does not change any warranty that otherwise applies to that product.

7. Limitation of Liability

Spyhold is not liable for indirect, incidental, special, or consequential damages, loss of data, loss of profit or revenue, or damages arising from use or inability to use the site or products, including but not limited to damages arising from the storage of third-party items in Spyhold products or any third party's access to such items. Liability is limited to the amount paid for the product involved.

The limitation of liability in this section does not reduce a valid gift card balance or limit any refund, cash redemption, or other right that cannot lawfully be excluded or limited.

8. Prohibited Uses

You may not use the site for unlawful purposes, interfere with its operation, scrape or extract data, upload malicious code, or bypass security measures. You may not use Spyhold products to conceal, transport, or distribute any illegal substance or item.

9. Indemnification

You agree to indemnify, defend, and hold Spyhold, its officers, directors, employees, agents, and affiliates harmless from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your misuse of the site or products; (b) your violation of these terms; (c) your storage of any item in a Spyhold product; or (d) any third party's access to items you have stored in a Spyhold product, including claims brought by or on behalf of minors.

10. Arbitration

Any dispute arising out of or relating to these Terms of Service or the use of Spyhold products will be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. Arbitration will take place in Westchester County, New York. You waive the right to a jury trial and the right to participate in a class action.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

12. Termination

We may suspend or terminate access to the site at our discretion.

13. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Changes

We may update these terms at any time. Continued use of the site after changes are posted constitutes your acceptance of the revised terms.

Changes to these Terms of Service apply only to gift cards purchased after the effective date of the change. A gift card already purchased remains governed by the Gift Card Terms in effect at purchase, except as required by law.

Gift Card Terms

Scope and use

These terms apply to digital gift cards issued by Spyhold LLC ("Spyhold," "we," or "us") and purchased at spyhold.com for use in our U.S. online retail store. Gift cards may be given as gifts. They may be redeemed at spyhold.com for eligible merchandise and the applicable taxes and shipping charges on that order. Gift cards cannot be used to buy another gift card. They cannot be resold or used for wholesale, commercial resale, or custom bulk orders unless we approve that use in writing. Promotional credits and merchandise return credits may have separate terms.

Value and payment

Gift cards are issued in U.S. dollars. Enter the gift card code at checkout. You can use all or part of the available balance, and any unused balance remains available for a later purchase. You may use more than one gift card on an order. If the order total exceeds the available gift card balance, you must pay the difference using another accepted payment method. A gift card does not reserve merchandise or guarantee future prices or availability.

No expiration or fees

Purchased gift cards do not expire, and we do not charge any fees in connection with them.

Gift card purchases are final

Gift card purchases are final and cannot be returned, canceled, refunded, or exchanged, except as required by applicable law. Gift cards are not redeemable for cash except as required by applicable law. If the law entitles you to a cash redemption of a remaining balance or another refund, contact q@spyhold.com. Nothing in these terms limits those rights.

Returns of merchandise paid for with a gift card

Merchandise purchased with a gift card remains eligible for return under our Returns and Exchanges Policy. An approved refund of the portion paid with a gift card will be credited to the original gift card or a replacement gift card, except as required by law. For an order paid partly with a gift card and partly with another payment method, refunds will be issued to the original payment method or methods, subject to applicable law. Cash or payment-card refunds will not exceed the amount originally paid using that method, unless required by law. Keep your gift card information until any return is complete.

Digital delivery

Gift cards are delivered electronically, not shipped as physical products. Delivery occurs after payment processing and any required order review. If a scheduled delivery option is offered and selected, the delivery date shown in that option applies. Delivery may be delayed by payment verification, fraud review, an incorrect email address, spam filtering, or technical issues. Check the email address before ordering and contact q@spyhold.com if you need delivery help. We do not guarantee immediate delivery.

Protecting your gift card

Keep your gift card code secure. Someone with access to the code may be able to use the balance. Contact q@spyhold.com promptly if a card or code is lost, stolen, sent to the wrong address, or used without permission. We may request reasonable proof of purchase or ownership before restoring access or replacing a card. Any replacement will be limited to the remaining balance we can verify, except as required by law. These terms do not limit any replacement or reimbursement right required by law.

Fraud and unauthorized use

To help prevent fraud, we may delay fulfillment, request reasonable verification, or temporarily suspend use of a gift card for no longer than reasonably necessary to investigate a reasonable concern about fraud, unlawful activity, nonpayment, or unauthorized use. If the concern is not substantiated, we will restore access to any legitimate remaining balance. We may cancel a gift card or refuse redemption when we confirm that the card was obtained unlawfully or its purchase payment was reversed, subject to applicable law. We will handle legitimate remaining balances and any required refunds in accordance with applicable law. A report, payment dispute, or chargeback does not by itself waive your statutory rights or automatically forfeit a legitimate balance.

Discounts and promotions

Discounts and promotional offers do not apply to the purchase of a gift card unless the offer expressly says otherwise. You may use a gift card to pay for merchandise that qualifies for a discount, subject to that offer's terms.

Other terms and future changes

Our Terms of Service, Privacy Policy, Shipping Policy, and Returns and Exchanges Policy also apply where relevant. If these Gift Card Terms conflict with another Spyhold policy about a purchased gift card, these Gift Card Terms control to the extent permitted by law. We may update these terms for future gift card purchases. We will not apply a change retroactively to reduce the value or rights attached to a gift card already purchased, except as required by law. Nothing in these terms excludes or limits rights that cannot lawfully be excluded or limited.

For balance, delivery, replacement, or legally required cash redemption assistance, contact q@spyhold.com. Please provide your order number, if available, and do not send the full gift card code unless our support team requests it through an appropriate channel.
